Joseph Mayo – Lead Patent Agent
Mr. Mayo is a Registered U.S. Patent Agent, (53288) and graduated from the Massachusetts Institute of Technology (MIT) in 1983. Mr. Mayo has more than 30 years of technical experience in hardware and software. Since passing the Patent Bar to become a patent agent in 2002, Mr. Mayo’s portfolio of experience has expanded to include strategic patent portfolio development, patent prosecution, post grant review proceedings, and litigation support, where Mr. Mayo provides technical input to attorneys.
Patent Agents, such as Mr. Mayo, are not attorneys, unless they have also passed a State Bar. An attorney that has not passed the Patent Bar cannot prosecute patent applications at the USPTO, but can provide legal opinions, prosecute trademark applications and litigate. Patent agents and patent attorneys both can provide patentability opinions as per the U.S. Supreme Court in Sperry v. Florida, however, Patent Agents cannot provide other opinions related to litigation. Hence, Mr. Mayo works with attorneys to provide services they cannot provide and visa versa.
Mr. Mayo works closely with inventors to strategically align their unique patent portfolios for profitability, investment, and maximization of market share opportunities. Mr. Mayo has been lead counsel in inter partes review proceedings, where Patent Agents are licensed to practice at the Patent Trial and Appeal Board (PTAB) to both attack and defend patents. In the litigation realm, Mr. Mayo provides litigation attorneys with technical savvy and patent expertise. His extensive experience in computer systems, hardware, software, medical devices, and mechanical devices has resulted in more than 500 patents being issued by the USPTO and abroad.
Mr. Mayo’s patent portfolio includes the representation of both U.S. and international companies, ranging from large corporations to start-ups and individual inventors. Successful patent prosecutions span the world, from the United States, to the EU, Japan, Australia, Brazil, China, India, Mexico, Canada, Spain, Taiwan, Russia, Korea, Germany, France, the UK, and Israel.
